A maze of state statutes and agency regulations govern sales of unpasteurized, or raw, milk, making it difficult to determine exactly how many states allow sales to the public, said Doug Farquhar, a program director for the National Conference of State Legislatures who has studied the issue.
Here’s what his research found:
STATE LAWS: Five states have laws explicitly allowing the sale of raw milk Arizona, California, Pennsylvania, New Hampshire and Vermont.
PENDING LEGISLATION: Seven states are considering legislation allowing the sale of raw milk Alaska, Georgia, Maryland, Michigan, New Jersey, New York and Ohio.
STATE REGULATIONS: Other states, such as Washington and many of those in New England, allow the sale of raw milk via agriculture or other department regulations.
FEDERAL REGULATIONS: The U.S. Food and Drug Administration does not allow raw milk to be shipped across state lines for sale to the public.
