IOWA: Supplier asks judge to dismiss E. coli lawsuit - (The Argus Leader)
January 31, 2008 – 7:40 pmA former produce supplier for Taco Johns was cited as asking a federal judge in Sioux Falls to throw out a lawsuit over contaminated lettuce.
The story explains that Taco Johns corporations in Huron and surrounding states filed suit in September against St. Pauls Bix Produce Company and three others, but did so under seal.
Bixs motion to dismiss filed Wednesday describes the allegations publicly for the first time. It says the Taco Johns corporations are suing because they lost business due to negative media publicity surrounding an E. coli outbreak at certain Taco Johns restaurants in Iowa and Minnesota.
The suit asked that a jury award $5 million in damages.
Taco Johns dropped Bix as a supplier in 2006 after contaminated lettuce showed up at restaurants in Albert Lea and Austin, Minn. and Cedar Falls and Waterloo, Iowa.
